Jane Penny is a defense attorney with over 30 years of experience in private practice. She concentrates her practice in defending clients during federal and state grand jury proceedings and white collar criminal matters involving false statements to government agents, Atomic Energy Act violations, mail fraud, environmental law, and public corruption. Some of her best work has involved keeping her clients anonymous and out of trouble. She measures her professional success by seeing how little attention her clients can attract rather than how much. She has long attained Martindale-Hubbell’s highest “AV” rating for legal ability and ethical standards.

Throughout her legal career, Ms. Penny has counseled numerous licensed operators and individuals in response to U.S. Nuclear Regulatory Commission/Office of Investigations (NRC/OI) probes into intentional violation of plant procedures, inaccurate statements to the NRC, safety-conscious work environment (SCWE) discrimination, security-related and force-on-force drill misconduct, and regulatory or plant performance violations culminating in referrals to the Department of Justice or United States Attorney’s Offices. These representations have taken her to many nuclear power plants throughout the United States. In addition, Ms. Penny has conducted confidential, or internal fact-finding investigations for companies in response to government inquiries, NRC referred allegations, employee hotline calls, and whistleblower reports of misconduct by management or union employees.

Since 2007, Ms. Penny has provided consultant services to the U.S. Department of Energy’s Office of Enforcement in connection with nuclear safety, worker safety and health, and classified information security enforcement investigations.

Ms. Penny has also represented individuals and corporations in cases or white collar criminal investigations involving allegations of the following:

Public corruption
Corporate misconduct
Money laundering
Government contracting fraud
Mail and wire fraud
False statements
Healthcare fraud
Environmental crimes
Atomic Energy Act violations

Ms. Penny currently serves as a Supreme Court appointed member of the Pennsylvania Commission on Judicial Independence.
